Throughout the site, the terms “we”, “us”, and “our” refer to The house of Kakkavo. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink.

I. Applicability & Modifications

1.1. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
1.2. Any new features, products, or tools added to the current store shall also be subject to the Terms of Service. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
1.3. The house of Kakkavo holds a valid pan-India FSSAI license, GST registration, and registered Trademarks for its brand name and logo. Any unauthorized commercial use of our intellectual property, product photography, or brand asset without prior written consent is strictly prohibited.

II. Ordering, Customization & Cancellations

2.1. Order Acceptance: All orders placed through our Shopify platform are subject to acceptance and stock availability. Because our chocolates are handcrafted in an artisanal, small-batch factory setup, we reserve the right to limit order quantities or reject an order due to sudden production constraints or incomplete customer information. We will notify you within 2 business days if there is any issue fulfilling your order.
2.2. Cancellations & Changes: Production begins shortly after an order is placed. You may request modifications or a cancellation within 2 hours of placing your order by contacting our support team directly.
2.3. Post-Dispatch: Once an order is handed over to our shipping partner (Shiprocket), the order enters transit and no changes, cancellations, or address rerouting can be processed.

III. Pricing & Payments

3.1. All prices listed on our website are stated in Indian Rupees (INR) and are inclusive of GST. Prices for our products are subject to change without notice.
3.2. Delivery charges and dynamic, temperature-controlled transit packaging charges are calculated extra at the checkout page based on the destination PIN code and order weight.
3.3. Payment Security: All payments are securely processed at the time of order placement via our integrated payment gateway partner, Razorpay. We accept all major Credit/Debit Cards, UPI, Net Banking, and authorized Mobile Wallets. We do not offer Cash on Delivery (COD) due to the highly temperature-sensitive and perishable nature of our artisanal products.

IV. Product Availability & Substitutions

4.1. KAKKAVO specializes in small-batch, premium, and artisanal chocolates. Since our items are handcrafted without industrial mass-production machinery, certain products or seasonal gift boxes may occasionally be out of stock or available only in strictly limited quantities during peak seasons.
4.2. For curated gift hampers or assorted festive boxes, KAKKAVO reserves the right to substitute an unavailable specific item with an alternative item of equal or greater value, ensuring the aesthetic, theme, and premium taste standards of the presentation are maintained.

V. Shipping, Delivery & Transfer of Risk

5.1. Address Accuracy: The buyer is completely responsible for providing a 100% accurate delivery address, active contact number, and correct PIN code. The house of Kakkavo is not legally or financially liable for transit delays, returns to origin (RTO), or failed deliveries caused by incorrect or incomplete shipping information provided by the buyer.
5.2. Delivery Attempts: Through our logistics aggregator Shiprocket, our courier partners will attempt delivery up to 3 times. If the recipient is unavailable, out of town, or refuses delivery on the initial attempt, we cannot guarantee the ideal shelf life, temperature maintenance, or final condition of the chocolate (such as melting).
5.3. Transfer of Risk: The risk of product damage, melting, or deterioration passes directly to the buyer once the package is successfully marked as "Delivered" by the courier partner according to the tracking log.
5.4. Force Majeure: We are not liable for delayed deliveries caused by factors beyond our reasonable control, including natural disasters, courier strikes, civil disruptions, extreme weather conditions, or systemic hub delays during heavy peak Indian festive seasons (e.g., Diwali, Rakshabandhan, New Year, etc.).

VI. Complaints, Replacements & Liability Limit

6.1. We take immense pride in our homemade quality. If you receive a damaged or severely melted product, you must notify KAKKAVO Customer Care within 24 hours of delivery with your Order ID, a brief description, and clear photographic/video evidence.
6.2. Claims received after 24 hours of delivery will not be entertained due to the highly perishable nature of fresh chocolate.
6.3. Upon reviewing and verifying your claim, KAKKAVO will, at its sole discretion, issue a Free Replacement or a Store Credit Coupon. Monetary refunds are not provided for transit damage. However, in the rare event that a shipment is completely lost in transit by the courier or cannot be fulfilled by us, a full monetary refund will be initiated via Razorpay to the original payment method.
6.4. Limitation of Liability: To the maximum extent permitted by Indian law, The house of Kakkavo shall not be liable for any indirect, incidental, punitive, or consequential damages (including loss of personal profits, occasion delays, or personal storage mismanagement after delivery) arising from the use or purchase of our products.

VII. Product Warranty & Care Instructions

7.1. We guarantee the freshness and premium quality of our artisanal chocolates for up to 3 weeks from the date of dispatch, provided they are stored under the recommended handling conditions (ideally in a cool, dry place between 15°C to 20°C, away from direct sunlight, moisture, and strong kitchen odors).
7.2. Minor "fat bloom" or "sugar bloom" (a harmless white film or spotting that can develop on chocolate due to natural cocoa butter separation during temperature fluctuations in transit) does not affect the safety, hygiene, or taste of the product. It is not considered a manufacturing or structural defect.

VIII. Personal Use & No Resale

8.1. By purchasing from our platform, you agree that the products are intended solely for personal consumption, family use, corporate gifting, or private gifting.
8.2. Commercial resale of KAKKAVO products on third-party platforms, physical stores, or commercial setups without prior explicit, written authorization from our legal officers is strictly prohibited.

IX. Governing Law & Jurisdiction

9.1. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.
9.2. Any legal disputes, claims, or actions arising out of transactions with The house of Kakkavo shall be subject to the exclusive jurisdiction of the competent courts located in Mohali, Punjab, India, where our production factory and registered setup are based.
